Mumbai, Nov 30 (PTI) The Bombay High Court today asked four youths, accused in an assault case, if they were willing to do some community service as a precondition to quashing the FIR lodged against them.
The four youths had approached the high court seeking quashing of the case against them on the ground that they have amicably resolved the dispute with the complainant.
The petitioners were accused of assaulting a man when he was coming out of a religious place early this year.
A division bench of Justices V M Kanade and Nutan Sardessai said people, who seek quashing of FIRs even if by mutual consent, must prove that they are really repentant and will not indulge in such acts in future.
“The petitioners should do some good work like clean a mosque or visit some jails in the state to witness what is the condition inside these jails and how inmates live. This may act as a deterrent,” the court said.
The court noted that since quashing FIRs in return of the accused doing some community service is not there in law the accused persons should volunteer to do such service.
The bench accordingly asked the petitioners to inform the court whether they where willing to abide by the condition by the next date of hearing.
The bench has asked the petitioners to reply by December 7. PTI SP NP
