New Delhi, Oct 13: In yet another twist in the sensational Aarushi Talwar-Hemraj double murder case, the Allahabad High Court has pointed towards Talwars’ compounder Krishna Thadarai as the main murder suspect. While castigating the Central Bureau of Investigation (CBI) for having “tampered with the case property”, the court observed that the agency had replaced a report which conclusively established Krishna’s involvement in the gruesome crime.
While acquitting Aarushi parents – Dr Nupur and Dr Rajesh Talwar – in the twin murder case, the Allahabad High Court on Thursday had said the circumstances of the case did not lead to the “irresistible conclusion” that Nupur and Rajesh had alone committed the murders.
Nupur and Rajesh had been convicted and sentenced to life by a CBI court for killing their daughter 14-year-old Aarushi and 45-year-old domestic help Hemraj in May 2008. The doctor couple had moved the Allahabad High Court against the November 28, 2013, trial court order.
While reading out their 273-page verdict, justices BK Narayana and AK Mishra quoted a Supreme Court ruling that underlined “graver the crime, greater should be the standard of proof”.
“The circumstances of this case upon being collectively considered do not lead to the irresistible conclusion that the appellants alone are the perpetrators of crime in question and on the evidence adduced in this case certainly two views are possible; one pointing to the guilt of the appellants; and the other to their innocence and in view of the principles expounded by the Apex Court in the case of Kali Ram (supra), we propose to adopt the view which is favourable to the appellants,” the High Court said.
