Brash blogger? Beware, you can be thrown in PrisonUgly new rules
In case you're a brash, bitter, sarcastic or a rude blogger who likes to take a shot at politicians, you're in for a rough time. Bloggers may no longer express their uninhibited views on everything under the sun, for According to the Supreme Court, you can be prosecuted for your shenanigans. This little act comes after a 19-year-old blogger found himself in hot water after scribbling some unfriendly views on shiv Sena. The boy, Ajith D from Kerala stared a community in social networking site Orkut to voice his opinions against Bal Thackray's Sena and even invited his friends to join. The boy received summons from a Maharashtra court but Chief Justice K G Balakrishnan and Justice P Sathasivam refused to protect him. The hate community comprised of numerous discussions regarding Shiv Sena trying to divide the country on region and caste basis. The Shiv Sena didn't find the community funny and filed an FIR against Ajith citing 'hurting of public sentiment.' Ajith was eventually bailed from the Kerala High court but he moved the Supreme Court, saying that the comments made on the blog were mere exercise of the fundamental right to freedom of expression and speech and could not be treated as an offence by police. He also pleaded that there was threat to his life if he appeared in a Maharashtra court. Unimpressed, the Bench said, "We cannot quash criminal proceedings. You are a computer student and you know how many people access internet portals. Hence, if someone files a criminal action on the basis of the content, then you will have to face the case. You have to go before the court and explain your conduct." February 24, 2009
