Cauvery Row: Supreme Court upholds order, Tamil Nadu continues to get 2,000 cusecs water per day
The apex court continued its interim order and directed Karnataka to release 2,000 cusecs of Cauvery water to Tamil Nadu every day.
New Delhi, Dec 9: The Supreme Court on Friday reiterated that the order to release 2000 cusecs of Cauvery water to Tamil Nadu will stand till further orders. The apex court continued its interim order directing Karnataka to release 2,000 cusecs of Cauvery water to Tamil Nadu every day. The court rejected the Centre’s stand that the Court had no jurisdiction to intervene in inter state river water disputes.
Rejecting the Centre’s stand, the bench of Justice Dipak Misra, Justice Amitava Roy and Justice A M Khanwilkar said that the interim order passed earlier would continue. The bench said that it would pass further orders on the sharing of Cauvery water on December 15.
Earlier on October 18, the apex court had directed Karnataka to supply 2,000 cusecs of water to Tamil Nadu till further orders. The state government had agreed to the decision and stuck to the apex court’s decision.
The Supreme Court had on October 4 directed Karnataka to release 2,000 cusecs Cauvery water every day to Tamil Nadu from October 7 to 18. It had deferred its initial order asking the Centre to set up a Cauvery Water Management Board (CWMB) till it decided on appeals relating to dispute. The top court on Thursday had directed Karnataka to continue to supply Tamil Nadu with 2,000 cusecs of water till further orders. The apex court said that its team would visit the sites to take a prima facie view of the ground reality and once CWMB was constituted and also submit a report.
Karnataka had moved a review petition in the apex court on October 1 against its three orders on Cauvery water release to Tamil Nadu and direction to the Centre to create the CWMB. Karnataka in its review petition said “grave miscarriage of justice” has been caused due to the three apex court orders of September 20, 27 and 30. The court had directed release 6000 cusecs of water till October 6 and the Centre was to constitute the Board by October 4.
