New Delhi, Oct 13: Rajesh Talwar and Nupur Talwar are set to walk out free after the Allahabad High Court acquitted them in the murder of their daughter Aarushi Talwar and domestic help Hemraj. The court has in its order hit out at the trial judge who had convicted the Talwars and sentenced them to life imprisonment in November 2013.

The division bench comprising Justices Bala Krishna Narain and Arvind Kumar Mishra allowed the appeals of the Talwars, holding that neither the circumstances nor the evidence on record established a chain showing their involvement in the murders of Aarushi and Hemraj. It also directed the authorities concerned to release both the appellants forthwith. (Highlights of the judgment)

Justice AK Mishra called the trial judge’s 2013 order as one pronounced out of “extra zeal and enthusiasm” and said that the judge meted out a “partial” verdict based on “self perception”. Justice Mishra said, “It is apparent that the trial Judge was unmindful of the basic tenets of law and its applicability to the given facts and circumstances of the case and failed to properly appraise facts and evaluate evidence and analyze various circumstances of this case. ”

Aarushi Talwar, the daughter of dentist couple Rajesh Talwar and Nupur Talwar, was found dead with her throat slit, inside the bedroom of her residence in Noida’s Jal Vayu Vihar in May 2008. The domestic help of Talwars, 45-year-old Hemraj, was initially suspected to be the one behind the crime after he went missing following Aarushi’s murder. However, two days later, his body was also recovered from the terrace of the house.

The case was initially probed by the Uttar Pradesh police and later, the investigation was handed over to the CBI. In 2013, a Ghaziabad court convicted the parents of Aarushi in the double murder case and sentenced them to life imprisonment.
