Netflix ‘Sacred Games’ Case: Actors Cannot be Held Liable For Dialogues, no New Episode Will be Aired, Says Delhi HC

Hearing pleas filed against Netflix and its web series Sacred Games for defaming former Prime Minister Rajiv Gandhi, the Delhi High Court said on Monday, July 16, that the actors cannot be held liable for the dialogues.

New Delhi, July 16: Hearing pleas filed against Netflix and its web series Sacred Games for defaming former Prime Minister Rajiv Gandhi, the Delhi High Court said on Monday, July 16, that the actors cannot be held liable for the dialogues. “Can we stop a viewpoint from being aired,” it asked

It further noted that all the eight episodes of the series have been aired and ruled that “no new episode will be aired” now, news agency ANI reported. The court will now hear the matter on July 19.

A number of pleas were filed to seek removal of some scenes alleging that offensive remarks were made against the former PM and his family. The pleas also alleged that the episodes also distorts history on the Bofors and Shah Bano cases, the Babri Masjid case and the communal riots.

The complaint was filed by Congress supporter Rajiv Sinha, a resident of Kolkata, who has accused the makers of “Sacred Games” of using a cuss word when referring to Rajiv Gandhi and also of “misinterpreting facts during his regime”.

The complainant said that the show had a scene in which Siddiqui, playing the protagonist, is seen and heard “abusing Rajiv Gandhi, calling him ‘fattu’, which was shown as pu*** in the subtitles”.

Addressing the row, Congress president Rahul Gandhi said that freedom of expression is a democratic fundamental right and the views of a character on the show cannot change what his father did for the country.

“The BJP/RSS believe the freedom of expression must be policed and controlled. I believe this freedom is a fundamental democratic right. My father lived and died in the service of India. The views of a character on a fictional web series can never change that,” he said.

The series is based on author Vikram Chandra’s novel of the same name. It has been directed by Anurag Kashyap and Vikramaditya Motwane.
