Lucknow, Apr 12: The Uttar Pradesh Police have filed an FIR against Bharatiya Janata Party MLA Kuldeep Singh Sengar in the Unnao gangrape case. The FIR has been filed under Sections 363, 366, 375 and 506 of the Indian Penal Code (IPC) and under the Protection of Children against Sexual Offences (POCSO) Act since the alleged rape survivor is a minor. He has been accused of kidnapping and rape. Shashi Singh, a woman from the rape survivor’s village, who claimed that Sengar was innocent, has also been named in the FIR. The Uttar Pradesh DGP said that the Unnao rape case has now been transferred to the Central Bureau of Investigation (CBI). When asked why the police was defending Sengar and why he was not arrested despite an FIR having been filed, UP DGP OP Singh said, “Nobody is defending him, all we are saying is that we have to hear both sides. Now case has been given to CBI, they will decide on arrest.”

Meanwhile, a midnight drama unfolded on Wednesday after the developments. Rape accused BJP MLA Sengar made a visit to the Senior Superintendent of Police’s (SSP) office with at least two dozen supporters. On being confronted by the reporters, Sengar said that he had come to know if he is also named in the FIR. “Hum to ye pata lagaane aaye the ki kahin hamara naam kisi FIR me hai ya nahi (I had come to know if my name has appeared in any FIR),” he said. “I just came here to prove that I have done no wrong and would be here any time the police wants me,” he said. Sengar also reportedly had a scuffle with media-persons present outside the SSP office.

The FIR came after the Special Investigation Team (SIT) visited the survivor’s village on Wednesday and submitted a preliminary report on the case to Chief Minister Yogi Adityanath. The SIT in its report accused Sengar of conspiring the death of the rape survivor’s father. The BJP MLA, however, refuted all the charges saying it is a conspiracy of his enemies.

Earlier on Wednesday, the rape survivor claimed that she and her family had been placed under “house arrest”. “We are not allowed to move out, we are constantly guarded…they want us to break down,” she told reporters. “I appeal to CM Yogi Adityanath to provide me justice. The DM has confined me to a hotel room, they are not even serving me water. I just want the culprit to be punished,” she said.

The Allahabad High Court took suo motu cognisance of the case following the custodial death of the victim’s father and said that the body of the rape victim’s father should be kept safe. The High Court will hear the case today. The Supreme Court also agreed to hear a plea seeking compensation and protection for the survivor’s family and request for CBI probe into the case. The apex court will hear the plea next week.

The father of the rape survivor died in police custody on Monday. He was arrested on April 8 after he along with his daughter attempted suicide in front of the Chief Minister’s residence in Lucknow. The woman has alleged that she was gangraped by Sengar and his accomplices in June 2017.
