Top 4 reasons Jayalalithaa may get bail in disproportionate assets case

The Karnataka High court will hear Jayalalithaa’s application seeking immediate bail and suspension of conviction and jail sentence in the disproportionate assets case on 1 October. Eminent criminal lawyer Ram Jethmalani has come at the resue for Jayalalithaa. Jethmalani have drafted the bail application stating Jayalalithaa’s medical condition. Jethmalani have stated in Jayalalithaa’s interlocutory petition for bail that she has suffered a lot in the past 18 years and now she is suffering from diabetes and high blood pressure. He has also stated that there is no connection with the subscriptions made to Jaya publications one of the 32 companies that figures in the company.

Top four reasons that Jayalalithaa may get a bail:

1-Om Prakash Chautala, who was a chief minister of Haryana from 24 July 1999 to 4 March 2005. He was charged in June 2008 in connection with the appointment of 3,206 junior teachers in Haryana in 1999-2000, and sentenced to 10 years imprisonment in January 2013. He got bail on september this year for medical reasons.

2-Similarly  in 2011, Karnataka Chief Minister B.S. Yeddyurappa was charged for corruption which forced him to step down from the Chief Minister post. Annoyed by that he quit BJP and formed his own KJP in 2012. In the May 2013 assembly elections, the KJP got 10 per cent of the votes, and the BJP lost power in the state. On December 2012, CBI court  granted bail to former chief minister.

3-Lalu Prasad Yadav had to step down as Chief Minister in 1997 as he was charged for Fodder scam. Rashtriya Janata Dal leader Lalu Prasad Yadav installed his wife, Rabri Devi as CM and the party went on to win another election. She remained in office till 2005. Last year, Yadav was convicted in fodder scam due to this he lost his Lok Sabha membership. The Supreme Court on december 2013 granted bail to RJD chief.

4-Eminent lawyer Ram Jethmalani have filed have drafted the bail application. He had known as a smuglers’ Lawyer. He is one of the most experienced criminal lawyers.

But in case of Jayalalithaa, She was sentenced for 4 years and whooping amount of 100 crore as fine. Her followers were expecting a sentence of 3 years. Legal experts say that the order passed by the Special Court is unassailable one. The law states that if a person is convicted to a term of 3 years and below she is entitled to apply for bail before the Special Court itself. In an event of a sentence of above 3 years, the convicted person will need to approach a higher court in appeal and seek bail.

However, in the case of Jayalalithaa she will run a proxy government as her party is in power. Tamil Nadu Assembly election 2016 would be quite intriguing as DMK would take up this as one of the agendas during the period against AIADMK. On the contrary AIADMK might get sympathy by this too.
