Winter Session of Parliament: Top 10 bills Narendra Modi government likely to table this session

After the meeting of the Cabinet Committee on Parliamentary Affairs on Sunday, the winter session of the Parliament will begin from November 24 and end on December 23. The winter session of Parliament will see Narendra Modi-led government push 67 bills that are stalled and require approval. Out of the 67 bills, 11 are that of the Health Ministry and Family Welfare alone and while Labour and Employment has 9 bills pending.

Of the pending bills, 9 were introduced in the previous Parliamentary session while 40 were introduced in the 15th Lok Sabha under the tenure of UPA-II government. According to PRS Legislative Research, as many as 18 other bills are pending from earlier Lok Sabhas’. As the BJP-led Central government set to make debut in its first winter session of parliament, we bring to you a list of 10 bills which will require speedy passage by the house for the welfare of the country.

1. The Juvenile Justice (Care and Protection of Children) Bill, 2014

The Juvenile Justice (Care and Protection of Children) Bill, 2014 was introduced to the Parliament on August 12, 2014 by Women and Child Development minister, Maneka Gandhi. The Bills asks for inclusion of safety measures for children in conflict with the law of the country. It also seeks a speedy development in pending adoption procedures and high dependency cases. Some of the key needs of the bills includes Juvenile Justice Boards (JJB) for each district in the country, more powers and responsibilities for JJB, speedy working of Child Welfare Committees, Special Juvenile Police Units (SJPU) and Child Welfare Police Officers.

2. The WAQF Properties (Eviction of Unauthorised Occupants) Bill, 2014

The WAQF Act, 1995 was introduced in Rajya Sabha on February 18, 2014 by the Minister of Minority Affairs, Mr. K. Rahman Khan. The WAQF Act addresses the issues of WAQF properties and the concerns of the buildings. The Bill applies to AUQAF and WAQF properties under the Durgah Khawaja Saheb Act, 1955. Properties under AUQAF properties include assets that are purchased or donated for charitable causes. But the bill would not be applicable to properties under the Ancient Monuments and Archaeological Sites and Remains Act, 1958.

3. The Prevention of Corruption (Amendment) Bill, 2013

Prevention of Corruption Act, 1988 was amended to make the Prevention of Corruption (Amendment) Bill, 2013. The bill makes has mentioned specific provisions in giving bribe to a public servant. It also seeks criminal misconduct to include only cover misappropriation of property and possession of disproportionate assets. It also redefines what penalties for accepting bribe should be.

4. The Indian Medical Council (Amendment) Bill, 2013

The  Indian Medical Council (Amendment) Bill,  2013 was introduced in the Rajya Sabha on August 19, 2014. The Act seeks to maintain standards of medical education, start new colleges and courses, register doctors and maintain the All India Medical Register and regulate medical professionals. Due to the default functioning in the Indian Medical Council Act, it was replaced by Board of Governors whose term expired on May 14, 2013.

 5. The Child Labour (Prohibition and Regulation) Amendment Bill, 2012

On December 4, 2012, the Child Labour (Prohibition and Regulation) Amendment Bill, 2012 was introduced in the Rajya Sabha by the Minister of Labour and Employment, Mallikarjun Kharge.  This bill does not want children to do hazardous jobs under dangerous conditions like mining or cracker factories, automobile workshops, bidi-making, carpet weaving, hand loom and power loom industry, mines and domestic work. The bill also includes a category ‘adolescent’ where children between the age group of 14 to 18 years are prohibited from engaging in hazardous occupation.

6. The Telecom Regulatory Authority of India (Amendment) Bill, 2008

The Telecom Regulatory Authority of India was set up by the Telecom Regulatory Authority of India Act, 1997. The act was made to regulate telecom services and revise tariffs for telecom services which was earlier under the Central Government.

7. Draft Road Transport and Safety Bill 2014

Draft Road Transport and Safety Bill 2014 seeks a scientifically planned and evolving framework for the road safety in the country. It wants cost efficient yet effective roads in India. They also ask for sustainable transport system in the country for speedy movement of people and goods.

8. Labour Reforms (Factories Act and  Apprentices Act)

In order to push major labour reforms, the Narendra Modi-led had introduced two major bills in it’s first parliamentary session earlier in June this year. To revamp the old archaic labour laws and fulfill its poll promises, the government had proposals in which aimed at creating millions of jobs and expand the manufacturing sector. The Modi-led government is set to amend laws in The Factories (Amendment) Bill and the Apprentices (Amendment) Bill, which were passed in 1948 and 1961 respectively. If passed, it is tipped off to ease the business activities and provide great flexibility in the service sector.

9. Insurance Laws (Amendment) Bill, 2008

In his first budgetary speech earlier this year, Finance Minister Arun Jaitley announced the hike of FDI in insurance sector to 49 percent from the current 26 percent. The proposal to this limit appraisal is pending since UPA government’s tenure in 2008. If the amendments are passed, it will help the Insurance companies to much desired capital from partners abroad.

10.  Land Acquisition (Amendment) Bill

Last week Arun Jaitley had suggested that the government will take tough decisions to ensure the reforms in The Land Acquisition Bill. The Bill was passed during the tenure of UPA government with then BJP as the Opposition. Provisions in the Land Acquisition Bill provides fair amount of compensation for farmland being taken over for industrial projects. However, the law has made the process of land acquisition very tough and it is severely affecting the quick implementation of projects. PM Modi has ruled the Ordinance route for the same, fearing that it’ll advantage Congress to portray BJP as anti-people.

Looking at the long list of 67 pending bills, it sure suggests that the going will be tough for BJP-led NDA government in it’s first winter session of Parliament. Though Narendra Modi and Finance Minister Arun Jaitley have suggested tough measures to bring back the economy on track, opposition parties have already announced that they won’t support the passage of Insurance and Land Acquisition (Amendment) Bills. While it is matter of debate if the ‘Achche Din’ for people are here or not, for the BJP the next 30 days will certainly not be achche.
