New Delhi: The Delhi high court on Saturday granted permission to an undertrial to write the Manipur Civil Service Examination. The undertrial is reportedly under prosecution in a murder case. The Manipur Civil Service (Combined) Competitive Preliminary Exams 2019 is scheduled to take place on May 12 from 10 AM to 12 PM and 2 PM to 4 PM. Therefore, the court has ordered that the accused be taken by a flight to Imphal on May 11.
The accused namely Benzi Takhellambam had applied for an interim bail in the High Court so that he could attempt the Manipur Civil Service Exams 2019 scheduled on Sunday. The accused will, therefore, write his exams at the centre which is a school in Manipur’s Imphal-West. Once the exam is over, the court has asked the authorities concerned to bring back the accused to Delhi on May 13.
Justice Sanjeev Sachdeva was quoted by a leading daily as saying, “Accordingly, the jail superintendent is directed to have the petitioner taken to Imphal by an economy flight. The cost of the ticket of the petitioner shall be borne by him. However, the cost of travel, boarding and lodging of the officers accompanying the petitioner shall be borne by the prison department of Delhi government.”
Though the prosecutor warned the court that the accused may abscond, the High Court approved the interim bail sought by the accused. Thus, the prosecutor submitted in the court that the accused be allowed to write the civil service examination under police custody.
The court had directed the Superintendent of Police, Imphal-West to ensure that boarding and lodging are provided to the police personnel accompanying the accused, either in the police station where the lock-up is situated or in Police Lines. The court also ordered that the accompanying police personnel be allowed to sit at a place in the examination centre from where they can see the accused. The court also made it clear that this order has been passed keeping in view of the peculiar facts and circumstances of the case and it shall not be treated as a precedent.
