National Herald Case: Delhi Court Disallows Subramanian Swamy’s Application Seeking Accused to ‘Admit or Deny’ Documents
The Delhi court, in its May 14 hearing, had reserved order on Subramanian Swamy’s applications for May 26. Swamy had filed three applications in which he had accused Congress President Rahul Gandhi and his mother Sonia Gandhi and others of allegedly misappropriating funds.
New Delhi, May 26: A Delhi court on Thursday disallowed Subramanian Swamy‘s petition in the ongoing National Herald case seeking Rahul and Sonia Gandhi to either admit or deny the documents filed by him on whether they are originals. The court, however, has allowed the Bharatiya Janata Party (BJP) leader to summon those documents, officials after examination, as evidence, news agency ANI reported.
The Delhi court, in its May 14 hearing, had reserved order on Subramanian Swamy’s applications for May 26. Swamy had filed three applications in which he had accused Congress President Rahul Gandhi and his mother Sonia Gandhi and others of allegedly misappropriating funds.
While in the first application the BJP leader had sought documents from Congress, in the second he had demanded the Congress leaders and others to either deny or admit if the documents were original. In the third application, Swamy had requested the court to take certain documents, relating to the National Herald case, as the record that he claims that he had found lying at his doorstep.
The court on Thursday denied Swamy’s second application. Swamy had also claimed that there are enough documents for the court to allow his demands sought in the applications. The accused — Sonia and Rahul Gandhi, Oscar Fernandes — have denied Swamy’s allegations.

Earlier, senior Congress leaders, including Motilal Vora and Oscar Fernandes, had told the court hearing the National Herald case that the complainant and BJP leader Subramanian Swamy was trying to defame them and vilify their party.
Other than the two leaders, Suman Dubey and Sam Pitroda made their submission before Additional Chief Metropolitan Magistrate Samar Vishal in response to an application moved by Swamy alleging that a Rs 414-crore fine was recently imposed on Young Indian Pvt Ltd by the Income Tax department in connection with the case.
Swamy, in a private criminal complaint, has accused the Gandhis and others of conspiring to cheat and misappropriate funds by paying just Rs 50 lakh, through which YI obtained the right to recover Rs 90.25 crore which Associate Journals Ltd owed to the Congress.
“The application is surrounded by malafide as the same has been filed for the purpose of causing defamation of the accused respondents and vilification of the Congress party,” the accused persons said in their replies. They also accused Swamy of “indulging in loud and persistent publicity amounting to an interference with the administration of justice”.
