Supreme Court Orders Stay on Any Amendment in Delhi Master Plan 2021, Says This Dadagiri Has to Stop

New Delhi, March 5: The Supreme Court on Tuesday ordered a stay on the proposed changes to the Delhi Master Plan 2021,  which is aimed at granting protection from the ongoing sealing drive in the national capital. Taking strong exception to the fact that neither the Delhi government nor the Delhi Development Authority (DDA) and the Municipal Corporations of Delhi (MCDs) had filed affidavits analysing the environmental impacts and safety issues of the proposed changes, a bench comprising Justices M B Lokur and Deepak Gupta said,” This is contempt, and nothing short of contempt. This dadagiri has to stop.”

The apex court also discharged BJP MLA Om Prakash Sharma and municipal councillor Gunjan Gupta, against whom it had earlier issued show cause notices for contempt for allegedly obstructing authorities from carrying out the sealing drive. The two-judge bench said that it went through CD containing video footage of protest and it showed that Sharma and Gupta were not obstructing the authorities.

However, it reprimanded Sharma for using derogatory language against Delhi CM Arvind Kejriwal during the sealing drive by the monitoring committee in east Delhi.

“You cannot insult the prime minister and any chief minister just because they are not from your political party. You must show respect to them. You are destroying the institution. This is absolutely unacceptable. Today you are insulting the chief minister of the Union Territory of Delhi. Tomorrow, you will insult the chief minister of a state and then the prime minister of our country, the bench observed.

The Supreme Court was hearing petitions against the unauthorized use of residential premises for commercial purposes. The DDA has recently proposed to finalise amendments to the Delhi Master Plan 2021 to provide immediate relief to traders.

The proposed amendments include increasing Floor Area Ratio (FAR) of shopping complexes from existing 180 per cent to 300 per cent, regularizing agricultural warehouses on 12 metre wide roads, allowing uniform FAR across localities and reducing conversion charges.

The sealing drive was being carried out against business establishments using residential areas for commercial purposes without paying conversion charges.
