Breaking News for all the AAm Admi Party and Delhi’s Cheif Minister Arvind Kejriwal’s supporters, The Delhi High court from the post of Chief minister of Delhi.
A division bench comprising Acting Chief Justice Manmohan and Justice Manmeet Pritam Singh Arora heard the matter.
ED arrested Arvind Kejriwal from his residence 6 days ago but he clearly stated that he will continue to discharge his duties from jail. After which a plea was moved by Surjit Singh Yadav, a Delhi resident claiming to be a farmer and social worker. He claimed that a Chief Minister accused of a financial scandal should not be permitted to continue in public office.
In the PIL, Yadav argued that if Kejriwal remains in his position as Chief Minister, it would not only stop the legal process and interfere with justice but also cause the state’s constitutional system to fail. Yadav believes that Kejriwal doesn’t meet the requirements laid out in Article 163 and 164 of the Indian Constitution for holding the position of Chief Minister.
He further argued that if a Chief Minister is in jail, they won’t be able to do any official work required by the law. Even if they’re allowed to work from jail, any document, even if it’s supposed to be secret, would have to be checked by prison officials before the CM sees it. This checking would break the promise of keeping official matters secret, which is part of the Chief Minister’s oath according to the Constitution.
Thought Delhi High court rejects the PIL For Removal Of Arvind Kejriwal, infact Kejriwal stated that he is going to run the govt from jail but there are several rumours that if he fails to do so then his wife who is also former IRS might replace him on that chair.
